A National Nightmare

This is an interesting interview with Matt Whitaker, who was the acting Attorney General between Jeff Sessions and Bill Barr (11/7/2018-2/14/2019).  The interview highlights how the Special Counsel Witch Hunt continued to severely weaken the rule of law in this country.  The interview also displays the difficulty that AG Bill Barr has in trying to restore the faith of true Americans in our justice system.

Whittaker notes that the Russia collusion investigation was artificially prolonged in the hope that President Donald Trump would move to terminate it and thus be accused of obstruction of justice.  This was the course of action that eventually led to the resignation of President Nixon back in the 70’s.

Soon after taking over for Jeff Sessions, Whitaker was briefed “on the contours and what was the Mueller investigation.”

“There was no evidence of any criminal conspiracy or connection or collusion, whatever you want to call it, between the Trump campaign, members of the Trump campaign—including Donald Trump—and the Russian government. So, therefore, the primary and sole purpose of that investigation had essentially failed to generate any evidence, and it was clear that that had been known for some time.”

While Whitaker downplays the length of time, it is clear from a myriad of sources that the Mueller Hit Squad knew this when Mueller stepped in as Special Counsel.  Whitaker went on to say:

“There should have been someone along that way that says that not only was there never any evidence, but we developed no new evidence, so, therefore, this investigation must be closed. There were so many people involved that could and should have made that decision. And to me, it looks as if it was kept open to harass this president, to undo the 2016 election, and to create an obstruction of justice trap.”

The man who is saying this was acting Attorney General.  Whitaker went on to note that “if we had tried to put our thumb on the scale or somehow, in their perception, interfere with the Mueller investigation that they were ready, willing, and able to go after any of us.”

This is chilling.  Now if only one man was saying this, one might think that he was trying to cover up his own lack of intestinal fortitude.  However, Whitaker comments are backed up by House Reps Jim Jordan (R-OH) and Devin Nunes (R-CA).

Both men knew from documents that they had viewed in various SCIF locations about the extent of the corrupt activity.  Nunes has been quoted as saying that the American public was going to be shocked when all the evidence came out.

However, they were unable to bring forward any of this information.  These people knew they would be targeted by this rogue group who were trying to overthrow the Presidency of Donald Trump.  They did not have to look any further than the Michael Flynn case to know this.  These traitors had an unlimited budget to go after them with.  This is like the Mafia ruling the country.

Whitaker went on to undercut the idea put forward in the Mueller Report of obstruction of justice by the President.  Whitaker was told by the Mueller Hit Squad that “attempted obstruction of justice is not a valid legal theory.”  This is in direct opposition to the Mueller Report that supposedly could not reach a conclusion about this.

The takeaway from this is that these Washington elites felt that they could do whatever they wanted to do.  A peaceful transition of power from one administration to the next, a hallmark of our country, was subverted by this process.  And this was all done “under color of law.”  These people used the law as a shield and a lever to do whatever they wanted to do.  They did not think that they would ever be held to account.

Besides holding these people to account (hopefully John Durham will do so), there need to be changes in the structure of the Special Counsel law.  The Special Counsel is, as Whitaker said, a “bolt-on” to the DOJ.  It is unnecessary.  There are 93 US Attorneys in the DOJ.  All investigative and prosecutive decisions should be possible within that framework.  The Special Counsel statue should be abolished.  It is too dangerous to give this kind of power to people with political agendas.
