Legal professor Alan Dershowitz gives a lengthy interview (15 minutes) with Steve Bannon about Alvin Bragg’s comedy show as well as touching on other cases underway in DC, Fulton County, Georgia and Mar-a-Lago.
Dershowitz touches on the felony aspects of this by noting that there is no associated crime listed. Bragg mumbled something during his news conference and then ran away. It is not in any of the indictments, 34 in all.
The only way they got to a felony charge was by stating that this mischaracterization of business records was done to conceal another crime. There is no other crime. The Federal Election Commission says so and so does the US Supreme Court (John Edwards case).
To have misdemeanor charge requires more than just something false in a business record. The defendant has to have “intent to defraud.” (To defraud generally means to take money or property by means of a deception on which the victim reasonably relies.)
Where is the intent to defraud? Who was defrauded (or intended to be)?
Apparently, some business ledger entries were mischaracterized. The amounts were supposedly correct but mislabeled. Then who was defrauded or intended to be defrauded by this? Who could potentially reasonably rely on the mislabeling and thereby lose money or property?
No one.
So, under the relevant NY statute, there is not even a misdemeanor here.
State power is being used to exhaust and relentlessly wear all of us down. It threatens us with business and financial loss, social cancellation/humiliation, accusation, arrest, indictment, and trial. Witness the J6 persecutions. Some have been held without bail for more than two years.
The DOJ recently announced to the court in DC that they expect to arrest and try some 1,000+ more people in the J6 “insurrection” that has consisted of people being invited into the Capitol by the police.
The Democrats have perverted the rule of law to go after their political opponents. They have destroyed the credibility of the FBI. The FBI is the East German Stasi and the Soviet KGB rolled into one.
All of this is intended to promote fear and to shut us up. The godless evil ones who hold the levers of power abhor the concept that our Rights come from God. This means that they are not gods nor are they kings. This diminishes them and drags them back to the same plane as the common person.
It seems to me that the Left is trying to foment a civil war. Then they can point to this as proof that many of the American public need to be restricted in their ability to participate in America’s future.
