Birthright Citizenship

How this subject will be decided at the Supreme Court is often a fool’s errand.  There are many and complex legal issues that need to be parsed out and understood.  There will be no attempt here to predict just what SCOTUS will decide.

I will only offer some of my own thoughts on this topic.

The Left’s argument for birthright citizenship is obviously insane.  I say this because they tell us all the time that we, American citizens, have no birthright.  We inhabit “stolen land” and do not belong here.

Yet, in the same breath, they claim that anchor babies, whose parents got here ten minutes ago, have a “birthright” and are tied to this nation for all time.  This is actually their position on this subject.

I think some people just have a hard time saying No to others and they don’t want to be known for causing someone else hardship. But all such people need to wake up to the realities of all the HARDSHIPS it creates FOR THEIR OWN COUNTRYMEN, when immigration isn’t kept to reasonable and feasible levels.

These people should be focusing on how letting these illegal aliens flood our country will adversely affect everyday Americans.  Don’t Americans need the jobs, housing, and other resources these people are taking?  How does this affect vulnerable people like our disabled, veterans, & elderly, who will be turned away from needed resources & services, left unhoused, etc., because illegal foreigners ate up all the resources?

Birthright citizenship in the form of anchor babies exacerbates this problem.  While homeless Americans are put on years-long waiting lists for housing subsidies & programs, etc. – illegals, especially those with young children, are fast tracked into these programs ahead of them! This leaves lower income Americans with nowhere to go.  Is this fair or right?

It is never a good thing, when people choose to transgress the rights and trespass upon the property of others, whether it is personal property, or national territory. It is ALWAYS an offense against, and causes harm to someone else.

The key phrase that people are arguing over at SCOTUS is “subject to the jurisdiction thereof.”  What is the meaning of this phrase within the framework of the 14th Amendment?  Does it exclude children of aliens who are here temporarily or illegally – people who are not fully subject to our jurisdiction in the complete sense because they still owe allegiance to their home country?  How many images have we seen of illegal aliens waving flags of their home countries while fighting against deportation to such countries?

Those that designed the 14th Amendment did not mean for it to be a loophole for lawbreakers or temporary visitors.  Such an interpretation dilutes the sovereignty of America.  China, for example, could send pregnant females here to give birth.  After birth those babies could return to China for 18 years and then return to this country as citizens.  This would undermine the country’s basic value system.  I doubt that the framers of this amendment had this in mind when they drafted the amendment.

How will all this work out?  As I said at the beginning, it is often a fool’s errand to predict the outcome of such cases.  We will just have to wait and see what the Court decides.
