New York Attorney General Letitia James displayed her communist bona fides again by suing PepsiCo.  James seems to be intent on driving as much business out of NY as possible.  The basis for the suit?  PepsiCo is a public nuisance by the way they package their products.

In the lawsuit filed in the NY State Supreme Court, James states that the company and its Frito-Lay subsidiaries have created a public nuisance through the production of multiple plastic wrappers and bottles, many of which end up discarded into the Buffalo River. In the lawsuit, it is argued that simply through the production of a lot of plastic the company was hurting the environment.

This is akin to holding auto companies responsible for someone who drives recklessly and causes an accident.  Or that gun companies are responsible for the actions of a mentally deranged individual who happens to get his/her hands on a gun and injures or kills other people.

Like a good communist, James wants to control all aspects of life in NY.  James contended that using plastic in their packaging somehow makes PepsiCo irresponsible.

James, a Communist Democrat, wants PepsiCo to warn customers about the potential health and environmental risks of its packaging.  It also wants the court to force the company to develop a plan to keep its packaging out of the Buffalo River.  And James also seeks financial penalties and restitution.

This is a trial balloon.  Success in court for James will unleash a barrage of lawsuits against all kinds of companies because they engage in commercial activities without the overriding presence of the government.  These attempts by supposedly impartial members of the legal system to coerce individuals and companies need to be shut down.

The next thing you know the government will be telling companies how big they can make their soda products.  Oh, that’s right, NYC has already done that.
